By accessing or using Festivly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Festivly is a platform that enables users to discover, rate, and share holiday light displays. Display owners can list their displays, and visitors can browse, save favorites, plan routes, and interact with listings. The Service is provided free of charge.

3. User Accounts

You must provide accurate and complete information when creating an account
You are responsible for maintaining the security of your account credentials
You must be at least 13 years old to create an account
One account per person; accounts are non-transferable
We reserve the right to suspend or terminate accounts that violate these terms

4. Display Listings

Display owners are responsible for the accuracy of their listings
All new listings are subject to review and approval by our team
Listings must represent real, physical holiday light displays
Display addresses are made publicly visible to help visitors find them
We reserve the right to remove listings that are inaccurate, inappropriate, or violate these terms
Community-submitted listings may be claimed by verified display owners

5. User Content

By submitting content (comments, ratings, photos) to Festivly, you:

Grant us a non-exclusive, royalty-free license to display the content on the platform
Represent that you own or have the right to share the content
Agree not to post content that is offensive, harmful, or violates any law
Acknowledge that we may remove content at our discretion

6. Acceptable Use

You agree not to:

Create fake or misleading display listings
Post spam, harassment, threats, or offensive content
Attempt to access other users' accounts or private data
Use automated tools to scrape or collect data from the Service
Interfere with the operation or security of the Service
Use the Service for any illegal purpose

7. Donations & External Links

Festivly allows display owners to include donation links to external platforms (e.g., GoFundMe, PayPal, Venmo). Festivly does not process, handle, or take responsibility for any financial transactions made through these external links. Use external donation services at your own discretion and risk.

8. Intellectual Property

The Festivly name, logo, and platform design are owned by Festivly. All user-uploaded content remains the property of the original creator, subject to the license granted in Section 5.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee the accuracy of display listings, operating hours, or availability. We are not responsible for the condition, safety, or accessibility of any listed display locations. Visit displays at your own risk and always respect the property and privacy of display owners.

10. Limitation of Liability

To the maximum extent permitted by law, Festivly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

11. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes will be communicated through the platform.
